POSITION DESCRIPTION

Position Title: Research Privacy Coordinator
FLSA Status: Exempt
Department: Office of Research & Sponsored Programs
Division: Research Integrity
Reports to: Director, Human Research Protections Program
Hours worked: Full Time = 35 hours per week

I. Position Summary:
Under the guidance of the Director, Human Research Protections Program, evaluates each human subject research studies that involve the use or disclosure of protected health information conducted at or under the auspices of Weill Cornell Medical College for compliance with the HIPAA Privacy and Security Rules. This includes reviewing all drafts of authorizations and waiver requests. In addition, the position is responsible for reviewing all data collection procedures to ensure compliance with federal and state regulations governing the use of human subjects in research. Other job responsibilities include conducting HIPAA training sessions, conducting HIPAA compliance audits, attending HIPAA and human subject related conferences and workshops as serving as the IRB Office representative on WCMC’s HIPAA Workgroup.

II. Position Activities:
Oversight
A. Serve on one or both of the WCMC-NYPH IRBs.
B. Act as the HIPAA privacy delegate responsible for certifying the accuracy and approval of HIPAA waivers or authorizations.
C. Work with the WCMC Privacy Officer, the Associate Legal Counsel, and the Institutional Review Board (IRB) to review, develop, and enforce HIPAA related polices for the Weill Cornell Medical College research community.
D. Edit, review, update, and re-write, when needed, the HIPAA forms, manual, and website information pages related to research to remain current with federal and state privacy rules and regulations.
E. Work with the WCMC Privacy Officer to identify possible disclosures, effectively track, and monitor actual disclosures related to research.
F. Address HIPAA related research questions from the Weill Cornell faculty, staff, and community.
G. Serve as resource for information regarding complicated HIPAA issues, especially with regard to psychotherapy notes in research, genetic testing, tissue banking, and treatment/research databases.
H. Under the guidance of the Director, Human Research Protections Program, assist in the review and dissemination of research protocols submitted to the IRB for review.

Education
A. Disseminate HIPAA Privacy and Security Rule related information to the research community.
B. Educate the WCMC & NYPH research communities – including research coordinators, staff, & faculty researchers and address public education regarding HIPAA as needed.
C. Develop succinct, accurate, and user-friendly guidelines for the WCMC & NYPH research communities, and create new avenues for disseminating these guidelines, e.g. a website or interactive CD-ROM.
D. Work with the IRB to ensure that Human Subject issues, under the Common Rule, are honored with respect to HIPAA.
Audit
A. Administer an audit program for HIPAA:
1) Devise a randomized and for-cause review process for non-compliance.
2) Check stated purposes for data use in HIPAA authorizations against actual procedures.
3) Check actual data collection systems against original protocol.
4) Mitigate and detect against potential violations of HIPAA compliance.
B. Work with QA/QI and Educational Outreach Manager with regard to HIPAA audits.

III. Minimum Requirements:
A. Bachelor’s degree required.
B. Must be knowledgeable of federal and state regulations, including HIPAA, governing the use of human subjects in research.
C. 3+ year’s experience working in the biomedical research field.
D. Ability to interpret federal, state regulations, university policy, and be knowledgeable of the workings of the IRB committee.
E. Excellent organizational, interpersonal, and communication skills.
F. Must be capable of independent decision-making.
G. Proficient in computers, word processing, and database applications.
